SUPREME COURT | LANDMARK JUDGMENT

Supreme Court Lays Down Safeguards in POCSO Cases Arising During Matrimonial & Child-Custody Disputes

Main Judgment

In ‘R’ v. ‘E’ & Anr., 2026 INSC 1049, the Supreme Court quashed the POCSO FIR against the father and his family, holding that continuation of the proceedings, on the material before the Court, would amount to an abuse of the process of law. The Court also considered the welfare of the child and directed that legal custody remain with the father, with a carefully supervised process for reintegration.

The Supreme Court further laid down safeguards for a defined category of cases where POCSO allegations arise against a parent or family member living with the child during a matrimonial dispute. The Court directed involvement of child and adolescent psychiatry or clinical psychology experts at specified stages, including before arrest in the circumstances covered by the judgment.

Key Facts

  • Husband ‘R’ and Wife ‘E’ were involved in a long-running matrimonial and child-custody dispute.
  • The father had earlier succeeded in obtaining custody of their minor daughter.
  • The mother later lodged FIR No. 76/2024, alleging POCSO and other offences against the father and his family.
  • The Supreme Court transferred the investigation to the CBI. The investigation included consideration of material such as CCTV evidence and expert psychological assessment. The CBI investigation was considered by the Supreme Court while assessing the allegations.
  • The Supreme Court consequently quashed the FIR and directed that legal custody of the child remain with the father, while providing for supervised reintegration through the Family Court.

Why It Matters

Important Legal Safeguard: The registration of a POCSO case during a matrimonial or child-custody dispute does not, by itself, establish the truth of the allegation or automatically defeat a parent’s legitimate custody claim. The Court has emphasised that the surrounding circumstances and material available in the case must be carefully examined.

Expert Evaluation: In the category of cases identified by the Supreme Court, where a POCSO allegation is made against a parent or family member living with the child and a matrimonial dispute exists between the parents, the investigating officer must engage a child and adolescent psychiatry or clinical psychology expert before forming the requisite basis for arrest under Section 35 of the BNSS. The expert’s assessment assists the decision-making process and does not itself determine the outcome of the investigation.

Private POCSO Complaints: The Court also prescribed an expert-evaluation safeguard in the specified circumstances where a Special Court is considering taking cognizance of a private complaint under Section 33 of the POCSO Act.

Important: The judgment does not dilute the protective purpose of the POCSO Act. Genuine allegations of child sexual abuse continue to require serious protection, investigation and judicial scrutiny. The safeguards laid down by the Court operate in the specific circumstances identified in the judgment.
